Privacy Policy for Pros Pos System

Introduction

Welcome to Pros Pos! This Privacy Policy explains how Pros Pos collects, uses, shares, and protects information in relation to our Point of Sale (POS) system, software, and related services.

This policy applies to the businesses and individuals (Merchants) who register for and use our Service. It also outlines our role and responsibilities concerning the data processed through our Service on behalf of our Merchants.

We are committed to protecting your privacy and handling your data in an open and transparent manner, in compliance with applicable data protection laws, including the Ghana Data Protection Act, 2012 (Act 843).  

2. Information We Collect

We collect information necessary to provide and improve our Service, support our Merchants, and meet legal obligations. This includes:

  • Merchant Account Information: When you sign up for our Service, we collect information such as your business name, contact person’s name, email address, phone number, physical address, business type, and account login credentials (username, password).
  • Payment Information: We collect billing details (such as credit card information or bank account details) to process payments for the Service subscription fees. This is often handled via secure third-party payment processors.
  • Transaction Data (Processed on Behalf of Merchants): Our POS system processes transaction information when you use it to make sales. This may include details about products/services sold, transaction amounts, payment methods (we typically do not store full credit card numbers post-authorization, adhering to PCI DSS standards where applicable), date/time of transaction, and potentially customer information if you choose to collect it through features like loyalty programs (e.g., customer name, email, phone number). Note: You, the Merchant, are generally the Data Controller for your customers’ data collected via the POS; we act as a Data Processor on your behalf for this data.
  • Usage Information: We collect information about how you interact with our Service, such as features used, clicks, settings preferences, IP addresses, device information (type, operating system), browser type, and access times.
  • Support Information: Information you provide when you contact our customer support team, including the content of your communications.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To Provide and Manage the Service: Set up and manage your account, process transactions, provide POS functionalities, and process subscription payments.
  • To Improve Our Service: Analyze usage patterns, troubleshoot issues, develop new features, and enhance user experience.
  • To Communicate With You: Send service-related announcements, invoices, technical notices, security alerts, and respond to your support requests or inquiries.
  • For Security and Fraud Prevention: Monitor for suspicious activity, prevent fraud, protect our systems and users, and enforce our terms of service.
  • For Legal and Compliance Purposes: Comply with applicable laws, regulations, legal processes, or government requests (e.g., tax reporting).
  • For Marketing (with Consent): Where permitted and with your consent where required, we may send you information about new features, promotions, or other services we think may interest you. You can opt out of marketing communications at any time.

4. How We Share Your Information

We do not sell your personal Merchant information. We may share information under the following circumstances:

  • With Service Providers: We share information with third-party vendors and service providers who perform services on our behalf, such as payment processing, data hosting, cloud storage, customer support tools, and analytics. These providers are contractually obligated to protect your data and use it only for the services they provide to us.  
  • For Transaction Processing: Transaction data is shared with payment processors, card networks, and financial institutions as necessary to complete the payment initiated by your customer.
  • For Legal Reasons: We may disclose information if required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.  
  • Business Transfers: In the event of a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our website of any change in ownership or uses of your personal information.  
  • With Your Consent: We may share information for other purposes with your explicit consent.  

5. Data Security

We implement technical and organizational measures designed to protect the security of the information we process. This includes measures like encryption (for data in transit and at rest where appropriate), access controls, regular security assessments, and staff training. However, please note that no electronic transmission or storage system is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security. You are also responsible for maintaining the security of your account credentials.  

6. Data Retention

We retain your Merchant account information for as long as your account is active or as needed to provide you with the Service. We retain transaction data processed on your behalf according to our agreement with you and our internal policies, or as required to comply with our legal obligations (e.g., financial record-keeping), resolve disputes, and enforce our agreements. We may retain anonymized or aggregated data indefinitely for analytics and service improvement.

7. Your Data Rights (Merchant Data)

Under the Ghana Data Protection Act, 2012 (Act 843) and other applicable laws, you have certain rights regarding your personal information that we hold. These may include the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate or incomplete information.
  • Request deletion of your personal information (subject to legal and contractual restrictions).  
  • Object to or restrict certain types of processing.
  • Withdraw consent (where processing is based on consent).

Note on End-Customer Data: Requests from your customers regarding their data processed through the POS system should typically be directed to you, the Merchant, as the Data Controller. We will assist you in responding to these requests as required by our agreement and applicable law.

8. International Data Transfers

If we transfer your personal information outside of Ghana (e.g., for data hosting), we will ensure appropriate safeguards are in place to protect your data by applicable legal requirements.

9. Children’s Privacy

Our Service is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected such information, we will take steps to delete it.  

10. Cookies and Tracking Technologies  

Our website and potentially parts of the POS service interface may use cookies and similar tracking technologies to enhance user experience, analyze usage, and manage the service. You can usually control cookie preferences through your browser settings.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of any material changes by posting the new policy on our website or through the Service, and updating the “Last Updated” date.
